Physician prescribing practices contributed to the US opioid epidemic, leading to increased regulation of opioid prescribing. In some instances, prescribers are unscrupulous or corrupt. They are criminally investigated and subject to prosecution. Less egregious opioid prescribing infractions are addressed through state medical licensing boards. At stake are physicians’ licenses to practice medicine.

There is an increasing number of voices—both in the relatively new academic field of film scholarship and outside it—claiming that film could be or even should be studied within science as opposed to the humanities. Among them, one finds some of the most distinguished film scholars teaching in film, literature, art history, or visual arts departments; their core argument is that their specific field needs to become more scientific. Previous research has established that the success of strikes, and social movements more broadly, depends on their ability to garner support from the public. However, there is scant published research investigating the response of the public to strike action by healthcare workers. In this study, we address this gap through a study of public responses to UK nursing strikes in 2022–2023, using a data set drawn from Twitter of more than 2300 publicly available tweets. We focus on negative tweets, investigating (...) which societal discourses social media users draw on to oppose strike action by nurses. Using a combination of corpus‐based approaches and discourse analysis, we identified five categories of opposition: (i) discourse discrediting nurses; (ii) discourse discrediting strikes by nurses; (iii) discourse on the National Health System; (iv) discourse about the fairness of strikers' demands and (v) discourse about potential harmful impact. Our findings show how social media users operationalise wider societal discourses about the nursing profession (e.g., associations with care, gender, vocation and sacrifice) as well as recent crises such as the Covid‐19 pandemic to justify their opposition. The results also provide valuable insights into misconceptions about nursing, strike action and patient harm, which can inform strategies for public communication. (shrink)

Background This paper describes the design, implementation, and process outcomes from three public deliberations held in three tribal communities. Although increasingly used around the globe to address collective challenges, our study is among the first to adapt public deliberation for use with exclusively Indigenous populations. In question was how to design deliberations for tribal communities and whether this adapted model would achieve key deliberative goals and be well received.Methods We adapted democratic deliberation, an approach to stakeholder engagement, for use with (...) three tribal communities to respect tribal values and customs. Public deliberation convenes people from diverse backgrounds in reasoned reflection and dialogue in search of collective solutions. The deliberation planning process and design were informed by frameworks of enclave deliberation and community-based participatory research, which share key egalitarian values. The deliberations were collaboratively designed with tribal leadership and extensive partner input and involvement in the deliberations. Each deliberation posed different, locally relevant questions about genomic research, but used the same deliberation structure and measures to gauge the quality and experience of deliberation.Results A total of 52 individuals participated in the deliberations across all three sites. Deliberants were balanced in gender, spanned decades in age, and were diverse in educational attainment and exposure to health research. Overall, the deliberations were positively evaluated. Participant perceptions and external observer datasets depict three deliberations that offered intensive conversation experiences in which participants learned from one another, reported feeling respected and connected to one another, and endorsed this intensive form of engagement.Conclusion The adapted deliberations achieved key deliberative goals and were generally well received. We identify two processes by which humans increase genetic exchange among groups of individuals: by affecting the distribution of groups and dispersal patterns across a landscape, and by affecting interbreeding among sympatric or parapatric groups. Each of these processes might then have two different effects on biodiversity: changes in the number of taxa through merging or splitting of groups, and the extinction/extirpation of taxa through effects on fitness. We review the various ways in which humans are affecting genetic exchange, and (...) highlight the difficulties in predicting the impacts on biodiversity. Gene flow and hybridization are crucially important evolutionary forces influencing biodiversity. Humans alter natural patterns of genetic exchange in myriad ways, and these anthropogenic effects are likely to influence the genetic integrity of populations and species. This paper focuses on Confucian formulations of personhood and the implications they may have for bioethics and medical practice. We discuss how an appreciation of the Confucian concept of personhood can provide insights into the practice of informed consent and, in particular, the role of family members and physicians in medical decision-making in societies influenced by Confucian culture. We suggest that Western notions of informed consent appear ethically misguided when viewed from a Confucian perspective.

This essay argues that a failure to think and talk critically and candidly about White privilege and White poverty is a key threat to the United States of America's precarious democracy. Whiteness frames one of America's most pressing collective challenges—the poor state of the nation's health, which lags behind other wealthy nations and is marred by deep and entrenched class‐ and race‐based inequities. The broadscale remedies experts recommend demand what is in short supply: trust in evidence, experts, government, and one (...) another. The authors’ prescription is threefold, beginning with a call for intersectional health studies and reports that avoid one‐dimensional misrepresentations of widespread health problems as simply Black or White problems. Second, there is the need for a “critical consciousness” about race and class. Lastly, the essay calls for widescale opportunities for Americans to engage in cross‐racial and cross‐class democratic conversations about their struggles and aspirations in search of common ground. Once common, therapeutic privilege—the practice whereby a physician withholds diagnostic or prognostic information from a patient intending to protect the patient—is now generally seen as unethical. However, instances of therapeutic privilege are common in some areas of clinical psychiatry. We describe therapeutic privilege in the context of borderline personality disorder, discuss the implications of diagnostic non-disclosure on integrated care and offer recommendations to promote diagnostic disclosure for this patient population. There are no data in this work.

A 2011 National Academies of Sciences report called for an “Information Commons” and a “Knowledge Network” to revolutionize biomedical research and clinical care. We interviewed 41 expert stakeholders to examine governance, access, data collection, and privacy in the context of a medical information commons. Stakeholders' attitudes about MICs align with the NAS vision of an Information Commons; however, differences of opinion regarding clinical use and access warrant further research to explore policy and technological solutions.

In this interview, Margaret A. Simons describes her path to philosophy and existentialism, her struggles in the male-dominated field in the 1960s and 1970s, and her political activism in the civil rights and women’s liberation movements. She also discusses her encounters with Simone de Beauvoir and Beauvoir’s refusal to own her philosophical originality, suggesting that Beauvoir may have adopted a more conventional narrative of a female intellectual to circumvent the public’s resistance to her radical ideas in the 1950s.

While the most prevalent means to measure the effectiveness of research ethics and integrity training formats is using learners’ self-assessment, there is a need for reliable and feasible self-assessment tools to evaluate the level of understanding. The aim of the study was to design a reliable tool and test its accuracy in various training contexts. The current study utilized a design-based research (DBR) approach. Data were collected from 401 participants in training sessions and ten experts were involved in tool evaluation. (...) The results indicate that in the context of research ethics and integrity learners can quite accurately (more than 80%) evaluate their level of understanding with the designed self-reflection form. The research revealed that participants who assessed themselves to have higher levels of understanding or who used the tool several times were more likely to provide well-elaborated descriptions of their learning that matched their indicated level of understanding. In cinematic experience, a view from nowhere appears in an instituting moment – neither in time nor out of time, but part of time itself – when a camera reflex lifts the viewer’s perception out of somewhere and into the infinite time of the film. We argue that the view from nowhere found in Birt Acres’s film Rough Sea at Dover – a fifteen-second shot of waves breaking against a sea wall in Dover, England in 1895 – transcends all attempts (...) to turn it into a view from somewhere, as an empty space that carries the auratic trace of the past into the present through phase shifts of technical mediation. In Simondon’s terms, the view from nowhere opens up possibilities of becoming all ways at once in the reflexive capacity of the human organon. Following Stiegler’s organological technics, we identify the capture of perception by the apparatus of recording and playback in the digitally automated algorithm as a threat to the reflexive capability of the organon to see otherwise in the creative individuation opened up in the phase-shifting process. Our analysis triggers a switch from an anthropocentric to a neganthropic-ecological mode of seeing in which the auratic trace of the event of waves crashing against the pier is seen in an inhuman view from nowhere that carries the threat of automatized systems in which human noesis – self-reflexive capacity – is eclipsed by machines. By seeing otherwise, the eclipse by machines is reversed to reveal the complex becoming of the film in its materiality as a work of creative individuation. (shrink)

Although there have been a growing number of studies focusing on dog welfare, the research field concerning dog positive emotion assessment remains mostly unexplored. This paper aims to provide a state-of-the-art review and summary of the scattered and disperse research on dog positive emotion assessment. The review notably details the current advancement in the dog positive emotion research, what approaches, measures, methods, and techniques have been implemented so far in emotion perception, processing, and response assessment. Moreover, we propose possible future (...) research directions for short-term emotion as well as longer-term emotional states assessment in dogs. Given the various shortcomings of classical phenomenological methods identified by critical and liberatory theorists, this paper considers what phenomenology has to offer theorists of multiply marginalized experience. The paper begins with an account of the major reasons for which Latinx feminists such as Linda Martín Alcoff, Jacqueline Martinez, and Mariana Ortega have found a phenomenological approach useful in their projects. This account reveals that though Latinx feminist phenomenologists have found useful resources for theorizing multiply marginalized theory and identity in the (...) classical texts of phenomenology, experiences unique to those subjected to marginalization remain significantly underdeveloped or absent from classical accounts. Taking seriously the primacy of lived experiences of ‘rupture’, this paper argues, is therefore necessary in the development of a phenomenological approach that does justice to life in the borderlands and the lived experience of being-between-worlds. Informed by the work of Latinx feminist theorists such as Gloria Anzaldúa and María Lugones, this paper closes with a proposed critical feminist phenomenological approach that centers the moment of ‘rupture’ described in such work. Ultimately, this paper argues that the communication and documentation of these ruptures in the form of phenomenological description allows for the examination and interrogation of sedimented logics of oppression on the way to liberatory ends. The focus of this article is university teachers’ and students’ views of plagiarism, plagiarism detection, and the use of plagiarism detection software as learning support. The data were collected from teachers and students who participated in a pilot project to test plagiarism detection software at a major university in Finland. The data were analysed through factor analysis, T-tests and inductive content analysis. Three distinct reasons for plagiarism were identified: intentional, unintentional and contextual. The teachers did not utilise plagiarism detection to (...) support student learning to any great extent. We discuss the pedagogical implications and suggest that the contextual reasons for plagiarism require focus primarily on study strategies, whereas the intentional reasons require profound discussion about attitudes and conceptions of good learning and university-level study habits. While philosophers generally agree that there can be no direct experience of the foreign consciousness, Simone de Beauvoir argues that literature makes it possible for us to enter the Other’s world. I will investigate the ways in which the position of the other and the position of the self-become one in the literary experience. Using phenomenology of the body as my point of departure, and analyzing the differences and convergences between verbal and literary communication acts, I will argue that the (...) text takes the place of the “inner speech” in the reading act. Consequently, the literary text acquires a kind of ownness, while it also appears as spoken by the other and having a reader-independent existence as a physical or electronic object. Literature does not provide us with the same possibilities of reciprocity, spatial perception and role-reversals as face-to-face encounters do; yet the very absence of the embodied other facilitates the adaption of his or her position and world as “one’s own”. The paper investigates various definitions of the concept of opinion as opposed to factual or evidence-based statements and proposes a taxonomy of opinions expressed in English as identified in selected social media. A discussion situates opinions in the realm of pragmatics and reaches to philosophy of language and cognitive science. The research methodology combines a thorough linguistic analysis of opinions, proposing their multifaceted taxonomy with the automatically generated lexical embeddings of positive and negative lexicon acquired from the analysed opinionated texts. As proposed, the definition of the concept of opinion is best apprehended when looked upon in terms of an opinion event, with a number of necessary conditions on the one hand, and those that are characteristic of an explicit opinion prototype on the other. Lists of opinion discourse markers show their preferential uses either in positive or negative opinionated texts; however, no sets of necessary and/or sufficient opinion markers properties have been acquired from the analysed texts. The conclusions indicate a polysemous understanding of naturally occurring social media opinionated texts and a definitional flexibility of the boundaries around lexical positive and negative types of opinion markers. The aim of this study was to investigate the consequences of the use of text-matching software on teachers’ and students’ conceptions of plagiarism and problems in academic writing. An electronic questionnaire included scale items, structured questions, and open-ended questions. The respondents were 85 teachers and 506 students in a large Finnish university. Methods of analysis included exploratory factor analysis, t-test, and inductive content analysis. Both teachers and students reported increased awareness of plagiarism and improvements in writing habits, as well as (...) concerns and limitations related to the system. The results suggest that teachers are inclined to think of plagiarism as part of a learning process rather an issue of morality, which may have consequences for how they understand the role of text matching. The introduction of text-matching software has supported teachers’ work, but at the same time teachers emphasized their own responsibility in detecting problems in student writing. The survey provides a limited sample of “Case Finland,” where implementation of text-matching software nationwide has been remarkably rapid; it offers a glimpse into one institution’s implementation of a newly introduced policy for mandatory plagiarism detection. For ages there has been a gap between the two cultures of the sciences and religions. According to Roger Sperry, science can now bridge the gap between the cold hard facts of the sciences and humanitarian and religious values. Sperry won the Nobel Prize in 1981 for his work on the differences between the left and right halves of the brain. For the past twenty years he has been campaigning for human consciousness and values to be investigated scientificlly. This book (...) describes Sperry's work and his struggle to guide humanity beyond a world divided. terms such as consciousness, value, love and joy are scientifically meaningful, just like terms referring to brain physiology, such as neural pathways and electrical impulse. The split between mind matter, or religion, and science can be removed, says Sperry, by expanding scientific research. Now, conscious experiences must be taken into account as scientific information about the brain. Our values, beliefs and goals can directly affect our brain states and physiology. (shrink)

Current advances in assisted reproductive technologies aim to promote the health and well-being of future children. They offer the possibility to select embryos with the greatest potential of being born healthy (eg, preimplantation genetic testing) and may someday correct faulty genes responsible for heritable diseases in the embryo (eg, human germline genome modification (HGGM)). Most laws and policy statements surrounding HGGM refer to the notion of ‘serious’ as a core criterion in determining what genetic diseases should be targeted by these (...) technologies. Yet, this notion remains vague and poorly defined, rendering its application challenging and decision making subjective and arbitrary. By way of background, we begin by briefly presenting two conceptual approaches to ‘health’ and ‘disease’: objectivism (ie, based on biological facts) and constructivism (ie, based on human values). The basic challenge under both is sorting out whether and to what extent social and environmental factors have a role in helping to define what qualifies as a ‘serious’ disease beyond the medical criteria. We then focus on how a human rights framework (eg, right to science and right to the highest attainable health) could integrate the concepts of objectivism and constructivism so as to provide guidance for a more actionable consideration of ‘serious’. Ultimately, it could be argued that a human rights framework, by way of its legally binding nature and its globally accepted norms and values, provides a more universal foundation for discussions of the ethical, legal and social implications of emerging or disruptive technologies. The starting point of this essay is the logical and political objection that Plato made against poetry, as well as the lack of distinction that he specified as the origin of its dangerousness, and which modernity converted into the condition of possibility of certain egalitarian forms of sensible experience and material life. I will then look at the function that the historical rearticulation of Platonic idealism has fulfilled from Romanticism to the present day in the age-old dispute between philosophy and (...) poetry, paying particular attention to the different readings of Hölderlin and Mallarmé carried out by Benjamin, Lacoue-Labarthe, and Agamben as symbols of the disfiguration of poetry. I will analyze the tension between sense and sound as the founder of an irreducible territory that opens a potentiality indicative of its political force. Lastly, I will turn to Michel Foucault’s The Government of Self and Others to analyze the function of messianism and parrhesia in the contemporary characterization of political poetry and its conflicts with the truth-telling of philosophy. ABSTRACT In 1978, the evolutionary biologist Robert Trivers and Huey P. Newton, cofounder of the Black Panthers, began a collaboration exploring the evolution of self-deception. Together they published a brief paper that used their ideas about the naturalistic basis of deceit and self-deception to explain the crash of Air Florida Flight 90 in Washington, D.C. Given the continued power of the naturalistic fallacy in the modern life sciences, historical attention typically focuses on highly visible controversies with great popular traction. This (...) essay instead mobilizes the muted legacy of Trivers and Newton's publication to underscore the inherent difficulties scientists face in finding a receptive audience for their theories, even naturalistic ones. Existing whistle-blowing models rely on “cold” economic calculations and cost-benefit analyses to explain the judgments and actions of potential whistle-blowers. I argue that “hot” cognitions – value conflict and emotions – should be added to these models. I propose a model of the whistle-blowing decision process that highlights the reciprocal influence of “hot” and “cold” cognitions and advocate research that explores how value conflict and emotions inform reporting decisions. I draw on the cognitive appraisal approach to emotions and on the (...) social-functional value pluralism model to generate propositions. (shrink)

At a time when there is a health care crisis in the United States, there is widespread appeal to religious healing of various types. Adequate research in this area is limited.Terms such as "ecstasy" are used inconsistently, limiting the usefulness of the term, producing confusion rather than understanding. A cross‐cultural comparative perspective is offered.

The United States Court of Appeals for the Second Circuit recently upheld United States District Court for the Eastern District of New York Judge's denial of petitioner's application for a writ of habeas corpus. The Court held that it was not objectively unreasonable for the Appellate Division to conclude, in light of clearly established federal law as expressed by the Supreme Court of the United States, that a New York statute providing for the recommitment of specific defendants who plead not (...) responsible by reason of mental disease or defect under a mere “preponderance of the evidence” standard does not violate either due process or the equal protection clause of the Fourteenth Amendment. In this reply, we wish to defend our original position and address several of the points raised by two excellent responses. The first response (De Miguel Beriain) questions the relevance of the notion of ‘serious’ within the context of human germline genome modification (HGGM). We argue that the ‘serious’ factor is relevant and that there is a need for medical and social lenses to delineate the limits of acceptability and initial permissible applications of HGGM. In this way, ‘serious’ acts as (...) a starting point for further discussions and debates on the acceptability of the potential clinical translation of HGGM. Therefore, there is a pressing need to clarify its scope, from a regulatory perspective, so as to prevent individuals from using HGGM for non-therapeutic or enhancement purposes. The second response (Kalsi) criticizes the narrow interpretation of the objectivist approach and the apparent bias towards material innovations when discussing the right to benefit from scientific advancements. As an in-depth discussion of the objectivist and constructivist approaches was beyond the scope of our original paper, we chose to focus on one specific objectivist account, one which focuses on biological and scientific facts. We agree, however, with the critique that material innovations should not be the sole focus of the right to benefit from scientific advancements, which also incorporates freedom of scientific research and access to scientific knowledge scientific freedom and knowledge, including the influence of these on ethical thinking and cultures. We propose that human reasoning relies on an inherence heuristic, an implicit cognitive process that leads people to explain observed patterns (e.g., girls wear pink) in terms of the inherent features of their constituents (e.g., pink is an inherently feminine color). We then demonstrate how this proposed heuristic can provide a unified account for a broad set of findings spanning areas of research that might at first appear unrelated (e.g., system justification, nominal realism, is–ought errors in moral reasoning). By revealing (...) the deep commonalities among the diverse phenomena that fall under its scope, our account is able to generate new insights into these phenomena, as well as new empirical predictions. A second main goal of this paper, aside from introducing the inherence heuristic, is to articulate the proposal that the heuristic serves as a foundation for the development of psychological essentialism. More specifically, we propose that essentialism—which is the common belief that natural and social categories are underlain by hidden, causally powerful “essences”—emerges over the first few years of life as an elaboration of the earlier, and more open-ended, intuitions supplied by the inherence heuristic. In the final part of the paper, we distinguish our proposal from competing accounts (e.g., Strevens' K-laws) and clarify the relationship between the inherence heuristic and related cognitive tendencies (e.g., the correspondence bias). In sum, this paper illuminates a basic cognitive process that emerges early in life and is likely to have profound effects on many aspects of human psychology. (shrink)

: The main contribution of this paper to current philosophical and sociological studies on modeling is to analyze modeling as an object-oriented interdisciplinary activity and thus to bring new insights into the wide, heterogeneous discourse on tools, forms and organization of interdisciplinary research. A detailed analysis of interdisciplinarity in the making of models is presented, focusing on long-standing interdisciplinary collaboration between specialists in infectious diseases, mathematicians and computer scientists. The analysis introduces a novel way of studying the elements of the (...) models as carriers of interdisciplinarity. These elements, being functionally interdependent building blocks, evolve during the modeling work and carry the disciplinary tensions in the process. This shows how the long and challenging process of defining and reformulating the object of research is crucial for understanding the dynamics of interdisciplinarity in the making. (shrink)
